Terms & Conditions

Terms & Conditions
You accept these terms and conditions as well as our privacy statement, which you can read here, by using our website to place orders for goods or services or to get in touch with us for any purpose.

1 Overview
Visitors ("visitors" or "you" or "your") to this website are provided with information by Cuttwood and its subsidiaries and affiliates ("we" or "us" or "our"), subject to the terms and conditions stated here, in our Privacy Statement, and any other pertinent terms and conditions, policies, and notices that may be applicable to a particular section of the website.
Terms and Conditions Specific to Product No. 2

2.1 Age Limitation
It is a must to be eighteen (18) years old to buy our products. Cuttwood will not sell anything to children, and we have the right, at our sole discretion, to revoke any order in which we suspect the buyer is trying to buy something for a juvenile.

2.2 Utilisation of Product
The electronic cigarette just fulfils the same function as a tobacco cigarette, which is to supply nicotine to the user. It does not treat a smoker's addiction to nicotine. It is advised that you speak with your healthcare provider about NRT (Nicotine Replacement Therapy) or a nicotine harm reduction programme if you have tobacco or nicotine dependence syndrome. We do not produce or market pharmaceuticals; we are not a pharmaceutical company. Before using any of our products, we advise you to consult your own medical professional for independent advice or information. It should be remembered that excessive nicotine usage might be hazardous. Nicotine is considered poisonous at concentrations higher than 2.5% (25 mg/ml). As a result, we are obligated by law to disclose safety information and warnings on certain items, which you may read on the relevant product pages. You acknowledge that using these items is at your own risk. Cuttwood will never be held accountable or liable, either directly or indirectly, for any loss or damage that results from using, or is claimed to have resulted from, any of the products we provide. Food safety authorities in the USA and/or Europe have verified all of our flavourings as safe for general food use, regardless of whether they are sold individually as flavour concentrates or included in pre-mixed e-liquids. As of right now, there is no legislation governing the manufacture of flavourings for inhalation. Nevertheless, it has been demonstrated that inhaling lipid-containing oils, colorings, diacetyl, acetoin, and acetyl propionyl can be hazardous. These ingredients are absent from all of our pre-made drinks and concentrates. Nevertheless, Cuttwood disclaims all liability for any claims or harm resulting from the use of food flavourings in personal vaporizers, electronic cigarettes, or other inhalation devices. Just like with cigarette smoking, using food-safe flavourings and personal vaporizers is entirely at the user's own risk. Products are not given out for trial or with the option to "use or return."

2.3 Product Cost and Placement
The price displayed at the time of ordering will be the entire cost of the goods you have ordered. Before you complete the order, the entire purchase price, shipping and packaging costs, and other relevant information will be shown to you on the checkout page. Adding products to your cart does not "reserve" them or ensure that you may place an order for them. Until you have made your payment in full, your order remains incomplete in the system. As a result, if someone else buys the same item at the same time and completes checkout before you, any limited-edition or quickly selling items in your cart may sell out. Kindly refrain from requesting that we combine your purchase or reimburse shipping fees if you place a subsequent order after realising that you forgot to order something. Our batch processing system may automatically merge several orders, or it may not, based on where the two orders are in the batch. This is not something we can change or accommodate.

2.4 Value-Added Tax (VAT)
In the UK, all of our products come with duty paid, and where applicable, sales tax (VAT) at the current rate of twenty percent (20%) is included in the purchase price. Customers residing outside of the UK are solely responsible for any additional tariffs or taxes that they may need to pay.

2.5 Transport
Only orders above £30* qualify for free delivery. When you check out, the shipping charges will be determined by the weight of the products in your cart. First Class Recorded Signed ForTM shipping is used for standard UK orders, while International Signed For TM Airmail shipping is used for orders going abroad. If payment is received before 2:00 PM GMT, we try to process and ship orders that same working day; if not, they are shipped the following working day. We cannot respond to shipping inquiries over the phone, and we are not liable for packages that are held up or seized by your internal customs authority. We ask that you wait until the regular delivery time period has gone before contacting us regarding non-delivery, as we won't be able to help until this time period has passed. If your basket is worth more than £50 and you live in the UK, you should choose to upgrade to Royal Mail Special Delivery TM Next Day, which offers a significantly more dependable service along with up to £500 worth of insurance. By choosing this option, you are upgrading the delivery method to Royal Mail UK Special Delivery TM Next Day Service, which will be delivered by 1pm the working day after despatch. However, you are not obtaining a warranty that your product will arrive the day after you place your purchase. Visit our Delivery Information Page for more details on this and other services. Once your item has been shipped, you will receive an email confirming it. Your order information will be at the bottom of the email, along with the Royal Mail reference. Before getting in touch with us to request the tracking reference, please make sure you have checked your spam filtered emails.

3 Broadly

3.1 Complete Agreement
The whole agreement between you and Cuttwood about your use of the website and its products is included in these terms and conditions. Any express, implicit, or inferred representation, warranty, promise, or similar term not specifically stated herein shall not bind either you or Cuttwood. These website's Terms and Conditions, unless otherwise noted, supersede and replace any and all previous written or oral agreements, promises, and representations between you and Cuttwood.

3.2 Information Security
Cuttwood guarantees that, to the extent necessary for the processing of personal data (as defined by the Act) in the performance of its obligations and exercise of its rights under this Agreement, it has made all pertinent notifications in compliance with its obligations under the Data Protection Act 1998. We consent to processing such personal data in accordance with the applicable provisions of the Data Protection Act of 1998 and any guidelines published by the Information Commissioner.

3.3 Modification
Cuttwood has the right to change any applicable policies, notices, or terms and conditions at any time. You understand that by periodically visiting the website, you will be bound by the relevant Terms and Conditions as they are currently published (the "current version"). Unless otherwise specified in the current version, all prior versions will be superseded by the current version. Every time you visit the website, you are in charge of checking the most recent version.

3.4 Tension
The other pertinent terms and conditions, policies, or notices that specifically relate to a particular section or module of the website shall prevail with regard to your use of the relevant section or module of the website in the event that any conflict or contradiction arises between the provisions of these website Terms and Conditions and any other relevant terms and conditions, policies, or notices.

3.5 Tolerable Conduct
Cuttwood reserves the right to do business only with those parties that they deem appropriate, to reject service to anyone who engages in unpleasant or obnoxious behaviour, makes any kind of false statement, violates any general internet policies by sending unsolicited spam, or who consistently receives complaints from customers regarding the goods and/or services they have received.

3.6 Discharge
Cuttwood reserves the right to transfer, assign, and delegate to any third party all or any of its rights and responsibilities under any applicable terms and conditions, policies, and notices.

3.7 Ability to Sever
Regardless of how they have been grammatically grouped or linked together, all of the terms and conditions, policies, and notices that apply are severable from one another. Any provision of any applicable policies, notices, or terms and conditions that is or becomes unenforceable in any jurisdiction for any reason—including invalidity, illegality, or unlawfulness—shall be treated as pro non scripto in that jurisdiction only and only to the extent that it is unenforceable. All other provisions of any applicable policies, notices, or terms and conditions will continue to be fully enforceable.

3.8 Relevant legislation
Without regard to any conflict of law rules, the laws of Great Britain shall govern and be construed in line with any applicable terms and conditions, policies, and notifications. By using this website, you agree that the High Court of Great Britain will have exclusive jurisdiction over any disputes arising out of or relating to it, as well as any applicable terms and conditions, policies, and notices.

3.9 Extinction
Insofar as such failure or delay results from a Force Majeure Event, neither party shall be responsible for any failure or delay in fulfilling its duties under the Agreement. Any incident beyond a party's reasonable control that was either unavoidable or, if it could have been predicted, could not have been foreseeable by its very nature is referred to as a force majeure event.

3.10 Thoughts or inquiries
Please get in touch with us if you have any queries, suggestions, or worries about the website, the privacy statement, or any other pertinent terms and conditions, policies, or notifications, or how we are using your personal information.
